The value of arbitration lies in more than obtaining an award. The dispute should be approached with a clear theory of the case, an evidence plan, an understanding of procedural choices and an enforcement strategy from the outset.
We work with clients to identify the contractual framework, factual record, damages position, witnesses, experts and procedural issues that may shape the arbitration. Early analysis can also identify whether settlement, interim measures or a narrower claim strategy would better protect the commercial objective.
Institutional arbitration and procedural planning
Our arbitration practice includes matters under DIAC, ICC and SIAC rules as well as other agreed procedures. Each framework has its own procedural requirements, but the core commercial questions remain similar: what relief is required, what evidence proves the claim or defence, and where an eventual award will need to be enforced.

Arbitration clauses and dispute prevention
A poorly drafted arbitration clause can create an unnecessary dispute about the dispute itself. Governing law, seat, institution, number of arbitrators, language, consolidation and related-contract issues should be considered when contracts are negotiated.
We review and draft arbitration clauses for commercial agreements and advise on whether existing clauses support the intended forum and enforcement strategy.
Awards, settlement and enforcement
The likely location of assets should be considered before significant time and cost are committed to proceedings. We advise on the practical relationship between arbitration strategy and recognition or enforcement in the UAE and other relevant jurisdictions.
Where settlement becomes commercially attractive, we also assist with documenting settlement terms so that payment, release and enforcement provisions are clear.
